क्या एक बार किए गए अपराध या बरी किए गए व्यक्ति पर उसी अपराध के लिए मुकदमा चलाया जा सकता है?

क्या एक बार किए गए अपराध या बरी किए गए व्यक्ति पर उसी अपराध के लिए मुकदमा चलाया जा सकता है ? नहीं  ,  एक बार किए गए अपराध या बरी किए गए व्यक्ति पर उसी अपराध के लिए मुकदमा नहीं चलाया जा सकता है। Section  300  Cr. P.C. पर आधारित है, maxim nemo debet bis vexari  जिसका अर्थ है कि किसी व्यक्ति पर उस अपराध के लिए दूसरी बार मुकदमा नहीं चलाया जा सकता है ,  जिसके लिए उस पर पहले उप धारा आरोप लगाया गया था। उपधारा (1) पहले से कोशिश किए गए किसी भी व्यक्ति के परीक्षण को रोकने के लिए। 1. कि उस पर एक ही अपराध के लिए एक सक्षम अदालत द्वारा मुकदमा चलाया गया है या जिसके लिए उस मुकदमे में उन पर आरोप लगाया गया हो या दोषी ठहराया गया हो ,  उसी तथ्य पर। [उपधारा (1) (2) ,  221 सीआरपीसी।  2. कि उसे मुकदमे में दोषी ठहराया गया था या बरी कर दिया गया था।  3.  कि ऐसा दोषसिद्धि या दोषमुक्ति लागू है। उपधारा ( 1)  धारा   300  सीआरपीसी ,  धारा  221 (1)  और ( 2)  के अंतर्गत आने वाले म...
